Part I

Terms of Service.

These Terms govern your access to and use of the EBENLUX website and the services provided by SGRIMPULSE LLC, doing business as EBENLUX. Read them carefully. By using the website or engaging EBENLUX, you accept these Terms.

1.1 Acceptance of Terms

By accessing or using the EBENLUX website (the “Site”), submitting a form, booking a consultation, or engaging EBENLUX in any commercial capacity, you (“you,” “user,” or “Client”) agree to be bound by these Terms of Service (“Terms”), together with the Privacy Policy and any applicable Service Agreement. If you do not agree, do not access the Site or use our services.

1.2 Company Information

EBENLUX is a brand and trade name of SGRIMPULSE LLC, a United States limited liability company. References in these Terms to “EBENLUX,” “we,” “our,” or “us” refer to SGRIMPULSE LLC doing business as EBENLUX. Services are provided from the United States. Operating details are listed in Section VIII (Contact Information).

1.3 Services Provided

EBENLUX is a growth partner for premium residential remodeling businesses. Services may include, without limitation:

  • Strategy, consulting, and premium positioning
  • Paid advertising on Meta, Google, and similar platforms
  • Lead generation and AI-assisted lead qualification
  • CRM setup, automation, and pipeline workflows
  • Speed-to-lead and follow-up systems
  • Appointment booking and scheduling integrations
  • Funnel and landing-page design
  • Email and SMS communication workflows
  • Retargeting, analytics, and conversion tracking
  • Sales pipeline optimization and reporting

The specific deliverables, timelines, fees, and scope of any engagement are set forth in a separate proposal, statement of work, invoice, or service agreement (each, a “Service Agreement”). In the event of a conflict between these Terms and a Service Agreement, the Service Agreement controls.

1.4 No Guarantee of Results

EBENLUX provides services on a best-effort, professional basis. Marketing, advertising, automation, lead generation, and growth services are inherently variable and depend on many factors outside our control — including market conditions, competition, offer quality, sales process and response time, follow-up, budget, creative direction, platform policies, and Client cooperation.

EBENLUX makes no warranty or guarantee, express or implied, regarding any specific revenue, return on investment, lead volume, appointments, qualified opportunities, conversion rates, sales, or business outcomes.

Case studies, examples, projections, screenshots, or performance references, where provided, are illustrative only and do not constitute a promise of similar results.

1.5 Client Responsibilities

The Client agrees to:

  • Provide accurate, timely, and lawful information, materials, and approvals;
  • Grant the access required to deliver services (advertising accounts, CRM platforms, domains, websites, analytics, etc.);
  • Comply with all applicable laws, regulations, advertising standards, and platform policies, including those of Meta, Google, and similar platforms;
  • Maintain advertising budgets and platform ad spend separately from EBENLUX service fees, unless expressly stated otherwise in a Service Agreement;
  • Review and approve creative, copy, and campaigns prior to launch where required;
  • Use deliverables only for the purposes contemplated by the engagement.

Client retains full responsibility for the legal, regulatory, financial, and professional compliance of its own business and offers.

1.6 Payment & Billing

Fees, billing cycles, setup fees, retainers, milestones, ad spend, refund eligibility, and cancellation terms are governed by the applicable Service Agreement. Unless otherwise stated:

  • Fees are quoted in U.S. dollars;
  • Invoices are due upon receipt;
  • Late payments may incur reasonable late fees, suspension of services, or termination;
  • Platform advertising spend is paid by the Client directly to the relevant platform and is separate from EBENLUX service fees;
  • All fees are non-refundable except as expressly set out in the Service Agreement.

1.7 Intellectual Property

EBENLUX retains all right, title, and interest in and to (a) pre-existing materials, methods, frameworks, processes, templates, prompts, training data, internal tools, and proprietary systems, and (b) any improvements thereto. The Site, including its design, copy, code, layout, graphics, and trademarks, is the property of SGRIMPULSE LLC and is protected by U.S. and international intellectual property laws.

Client retains ownership of Client-provided materials (logos, brand assets, photography, copy supplied by Client). Upon full payment, Client receives a non-exclusive, non-transferable license to use approved final deliverables for the Client's own internal business purposes, subject to any restrictions in the Service Agreement.

You may not copy, scrape, republish, modify, reverse-engineer, distribute, or commercially exploit any portion of the Site or its contents without prior written permission.

1.8 Acceptable Use & Prohibited Conduct

You agree not to:

  • Use the Site or services for any unlawful, fraudulent, deceptive, or misleading purpose;
  • Interfere with or attempt to compromise the security, integrity, or operation of the Site;
  • Scrape, harvest, or extract data from the Site through automated means;
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
  • Transmit malware, viruses, or any harmful or disruptive code;
  • Use the Site or services in a manner that violates any third-party platform's terms or any applicable law.

1.9 Third-Party Tools & Platforms

EBENLUX uses third-party platforms to deliver services, which may include CRM and automation platforms (such as GoHighLevel, HubSpot, or similar), advertising platforms (Meta, Google, TikTok, YouTube), analytics tools (such as Google Analytics, Meta Pixel), scheduling tools (Calendly and similar), email and SMS providers, payment processors, AI tools, and hosting providers.

These platforms are operated by third parties under their own terms and privacy policies. EBENLUX is not responsible for third-party outages, policy changes, account bans, pricing changes, feature removals, or platform-level decisions affecting Client campaigns, data, or accounts.

1.10 Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall SGRIMPULSE LLC, EBENLUX, or their members, managers, employees, contractors, agents, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation lost profits, lost revenue, lost data, business interruption, or loss of goodwill, arising out of or in connection with the Site, the services, or these Terms, even if advised of the possibility of such damages.

The aggregate liability of EBENLUX for any direct damages arising out of these Terms or the services shall not exceed the total fees paid by Client to EBENLUX in the three (3) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not permit certain limitations of liability or exclusions of warranties. The foregoing limitations apply to the maximum extent permitted by law in your jurisdiction.

1.11 Indemnification

You agree to defend, indemnify, and hold harmless SGRIMPULSE LLC, EBENLUX, and their officers, members, employees, contractors, and agents from and against any claim, demand, loss, damage, liability, cost, or expense (including reasonable attorneys' fees) arising from:

  • Client-provided materials, instructions, approvals, or offers;
  • Your use or misuse of the Site or services;
  • Your violation of any law, regulation, or third-party right;
  • Your breach of these Terms or any Service Agreement.

1.12 Termination

Either party may terminate an engagement as set forth in the applicable Service Agreement. EBENLUX may suspend or terminate access to the Site or services at any time, with or without notice, for any breach of these Terms or for any unlawful or harmful conduct. Upon termination, provisions that by their nature should survive — including intellectual property, payment, limitation of liability, indemnification, and dispute resolution — will survive.

1.13 Disclaimers

The Site and Services are provided “as is” and “as available” without warranties of any kind, express or implied, including without limitation any warranties of merchantability, fitness for a particular purpose, title, non-infringement, or that the Site will be uninterrupted, secure, or error-free.

1.14 Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of [Florida], without regard to its conflict-of-laws principles. The parties agree to first attempt, in good faith, to resolve any dispute informally for at least thirty (30) days before initiating any formal proceeding. Any unresolved dispute shall be submitted to the state or federal courts located in [Florida], or to binding arbitration if mutually agreed in writing.

1.15 Modifications to These Terms

We may modify these Terms from time to time. Updates take effect when posted to the Site. The “Last Updated” date at the top of this page reflects the most recent revision. Your continued use of the Site or services after changes are posted constitutes acceptance of the updated Terms.

1.16 Entire Agreement & Severability

These Terms, together with the Privacy Policy and any applicable Service Agreement, constitute the entire agreement between you and EBENLUX with respect to the subject matter and supersede all prior or contemporaneous understandings. If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.

Part II

Privacy Policy.

This Policy explains how EBENLUX collects, uses, shares, and protects information when you visit the Site, submit a form, schedule a call, or engage with our services. We treat privacy seriously and aim to be clear about how data flows through our systems.

2.1 Introduction & Scope

This Privacy Policy applies to information collected through the EBENLUX website, landing pages, booking and scheduling pages, contact forms, advertising campaigns, and direct communications with EBENLUX. It does not apply to third-party websites or platforms, which are governed by their own policies.

2.2 Information We Collect

Information you provide directly:

  • Name, business name, role
  • Email address and phone number
  • Website URL, company size, location, industry
  • Project details, growth goals, budget range
  • Appointment and booking information
  • Content of communications with EBENLUX
  • Payment-related information (processed by our payment provider; we do not store full card numbers)

Information collected automatically:

  • IP address and approximate geographic location (city / region)
  • Device type, operating system, and browser
  • Referring and exit pages
  • Pages viewed, time spent, click and interaction events
  • Advertising-platform identifiers, where applicable
  • Cookie, pixel, and similar tracking identifiers

Information received from third parties:

  • Advertising platforms (Meta, Google, and similar) regarding ad interactions and conversions
  • Analytics platforms (such as Google Analytics)
  • CRM and form integrations
  • Lead enrichment or data partners, where used

2.3 How We Use Information

We use information to:

  • Respond to inquiries and schedule consultations
  • Provide, deliver, and support our services
  • Operate, maintain, and improve the Site
  • Send marketing, operational, and transactional communications by email, phone, and SMS
  • Personalize and optimize the user experience
  • Measure marketing performance and ROI
  • Run advertising, retargeting, and conversion campaigns
  • Maintain and protect the security of our systems
  • Detect, prevent, and address fraud or abuse
  • Comply with legal, regulatory, and contractual obligations

Please do not submit sensitive personal information (medical, financial account credentials, government IDs, etc.) through general website forms. Use the secure channels we provide if such information is required for an engagement.

2.4 How We Share Information

We share information only as needed to operate our business and deliver services. Categories of recipients include:

  • Service providers and processors — CRM, scheduling, hosting, email/SMS, analytics, advertising, payment processors, automation, and AI providers
  • Professional advisors — legal, accounting, insurance
  • Affiliates of SGRIMPULSE LLC
  • Authorities — regulators or courts, where required by law or to protect rights, safety, or property
  • Acquirers — in connection with a merger, acquisition, financing, reorganization, or sale of assets

We do not sell personal information for monetary consideration. We may share information for advertising and analytics purposes that, under certain U.S. state laws, may be considered “sharing” or “targeted advertising.” You may opt out as described in Section VI.

2.5 Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against loss, misuse, and unauthorized access. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

2.6 Data Retention

We retain personal information for as long as needed to fulfill the purposes described in this Policy, including delivering services, managing client relationships, satisfying contractual obligations, complying with legal requirements, resolving disputes, and enforcing agreements. When information is no longer required, we delete or anonymize it.

2.7 Children's Privacy

The Site is not directed to children under thirteen (13). We do not knowingly collect personal information from children under thirteen. If you believe we have inadvertently collected such information, please contact us and we will take steps to delete it.

2.8 International Users

EBENLUX operates from the United States. If you access the Site or engage with EBENLUX from outside the U.S., your information will be transferred to, stored, and processed in the United States, which may have different data protection laws than your country of residence.

2.9 Do Not Track

Some browsers offer a “Do Not Track” setting. There is currently no industry consensus on how to respond. We do not respond to DNT signals in a uniform way; you may exercise the privacy rights described in Section VI.

2.10 Changes to This Policy

We may update this Policy from time to time. The “Last Updated” date at the top of this page reflects the most recent revision. Material changes will be communicated through the Site or, where appropriate, by email.

Cookies & Tracking.

We use cookies, pixels, beacons, SDKs, and similar technologies to operate the Site, measure how it is used, run advertising, and improve the experience.

3.1 What Cookies We Use

Cookies fall into the following general categories:

  • Strictly necessary — required for the Site to function (e.g., session, security, load balancing)
  • Functional — remember preferences and personalize experience
  • Performance & analytics — aggregate usage measurement, page performance, conversion tracking

SMS & Email Consent.

How we may contact you, and how to opt out at any time.

4.1 Consent to Be Contacted

By submitting a form, booking a consultation, or otherwise providing your contact information to EBENLUX, you consent to be contacted by EBENLUX — or by service providers acting on our behalf — by email, telephone, and/or SMS, including through automated systems, regarding your inquiry, our services, follow-up communications, scheduling, and related marketing.

4.2 Email

You may unsubscribe from marketing emails at any time by clicking the “unsubscribe” link included in any marketing email or by emailing [[email protected]] with the subject line “Unsubscribe.” Operational and transactional emails (e.g., billing notices, service updates, security notifications) may continue as necessary to administer the relationship.

4.3 SMS Messaging

Message and data rates may apply. Message frequency varies based on your activity and our communications. You may opt out of SMS at any time by replying STOP to any SMS message from EBENLUX. For help, reply HELP. Carriers are not liable for delayed or undelivered messages.

By providing your mobile number, you confirm that you are authorized to receive SMS messages at that number and agree to the SMS terms above. Your consent to SMS is not a condition of any purchase.

4.4 Phone Calls

You may ask to be removed from our calling list at any time by emailing [[email protected]] or by informing the caller during any call.

Part V

Advertising & Analytics.

How we measure performance, how interest-based advertising works, and where to opt out.

5.1 Third-Party Advertising & Analytics

We use third-party advertising and analytics tools, including without limitation Google Ads, Google Analytics, Google Tag Manager, Meta Ads (Facebook & Instagram), and similar providers. These tools may set cookies, pixels, or device identifiers and may receive information about your interactions with the Site for purposes of measurement, optimization, audience building, retargeting, and ad delivery across third-party properties.

5.2 Industry Opt-Outs

To opt out of interest-based advertising more broadly, you may visit:

  • youradchoices.ca — Canada

You may also use the privacy settings provided by individual platforms (Google, Meta, etc.) to control ad personalization.

5.3 Conversion Tracking

When you submit a form or complete an action on the Site, we may transmit a conversion event (often with hashed or anonymized identifiers) to advertising platforms to measure the performance of our campaigns. This helps us understand which ads work and improve future campaigns. No raw, unhashed personal information is shared with advertising platforms beyond what is required for measurement.

Your Privacy Rights.

Depending on your jurisdiction, you may have rights regarding your personal information. We honor these rights to the extent applicable law requires.

6.1 General Rights

You may request to:

  • Access the personal information we hold about you
  • Correct inaccurate or incomplete information
  • Delete personal information, subject to legal and operational exceptions
  • Restrict or object to certain processing
  • Receive a portable copy of certain information
  • Withdraw consent (where processing is based on consent)
  • Opt out of marketing communications
  • Opt out of “sale” or “sharing” of personal information for cross-context behavioral advertising

6.2 California Privacy Notice (CCPA / CPRA)

If you are a California resident, you may have additional rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, including the rights to know, access, delete, correct, limit use of sensitive information, and opt out of sale/sharing for cross-context behavioral advertising. We have collected the categories of personal information described in Section 2.2 for the purposes described in Section 2.3 in the prior twelve (12) months. We do not knowingly sell personal information of consumers under sixteen (16) without consent.

6.3 Other U.S. States

Residents of other U.S. states with comprehensive privacy laws (including Colorado, Connecticut, Virginia, Utah, and others as enacted) may have similar rights. We honor verified requests to the extent required by applicable law.

7.1 No Guarantee of Marketing Results

Marketing, advertising, AI qualification, automation, lead generation, and funnel services are by nature variable. Outcomes depend on factors including offer, market, sales process, follow-up cadence, response time, creative, budget, competition, platform behavior, and execution — many of which are outside EBENLUX's control. EBENLUX does not guarantee specific revenue, ROI, lead volume, booked calls, qualified opportunities, conversions, or any other business outcome.

7.2 Illustrative Examples Only

Any case studies, projections, charts, screenshots, examples, or performance references on the Site or in our materials are illustrative and should not be interpreted as a promise of comparable results for your business.

7.3 No Professional Advice

Content on the Site is for general informational purposes and is not legal, financial, tax, accounting, medical, or professional advice. You should consult qualified professionals for advice tailored to your situation.
